Drake is sued over a sample in his track called “Pound Cake/Paris Morton Music 2″. TMZ reports that the Canadian rapper has been accused of illegally using some lyrics of “Jimmy Smith Rap”, a 1982 song recorded by late jazz musician Jimmy Smith.
Although the liner notes suggest that the sample was properly licensed, Smith’s estate insist in their lawsuit that Drake never got the permission to use the sample. They also say that nobody asked to use it.
Smith’s estate is now looking for over $300,000 in compensation from Drake, Cash Money records and a few others involved. The “Started From the Bottom” hitmaker has yet to comment on the news.
“Pound Cake/Paris Morton Music 2″ is a track off “Nothing Was the Same”, Drake’s 2013 album that peaked at No. 1 on Billboard 200. Produced by Boi-1da, the song also features a sample of the Ellie Goulding song “Don’t Say a Word” and a sample of “C.R.E.A.M.” by Wu-Tang Clan.
